    TERMS AND CONDITIONS OF BUSINESS

    1. About Us
      1.1. This website and the Zanom Automotive business are operated by Zanom Ltd (company number 14238774) trading as Zanom Automotive.
      1.2. Registered office: Unit 16, Imperial Park, Towerfield Rd, Shoeburyness, Southend-On-Sea, England, SS3 9QT.

    1. Definitions
      "Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
      "Business Customer" means a person acting for purposes relating to their trade, business, craft or profession.
      "Vehicle" means a motor vehicle offered for sale by us.
      "Reservation Fee" means a payment taken to secure a Vehicle for viewing (and to prevent it being sold to another customer) and does not itself create a contract of sale.
      "On-Premises Contract" means a contract concluded at our premises.
      "Distance/Off-Premises Contract" has the meaning given under consumer contract rules (generally where the contract is concluded without you attending our premises).

     

    1. Scope of These Terms
      3.1. These Terms apply to: (a) your use of our website; (b) any Vehicle Reservation Fee you pay; (c) Vehicle sales; and (d) workshop services. 3.2. Where we provide you with a separate signed order form, job card, invoice, or written quotation, that document forms part of the contract and will apply alongside these Terms.

     

    1. Website Use
      4.1. Website content is provided for general information and advertising. While we take reasonable care, content may occasionally contain errors/omissions.
      4.2. You must not misuse the website (including introducing malware, attempting unauthorised access, or interfering with normal operation).
      4.3. We may suspend or restrict access to the website for operational or security reasons.

     

    1. Vehicle Advertising Information (Important)
      5.1. Listings, descriptions, and images are intended to be a fair representation, but used vehicles will show age/mileage-related wear unless stated otherwise.
      5.2. Mileage may increase due to test drives, movement, or checks.
      5.3. You should inspect and test drive the Vehicle and satisfy yourself as to its condition/features before purchase.

     

    1. Our Sales Model: No Organised Distance-Selling for Vehicle Sales
      6.1. We do not operate an organised distance-selling regime for Vehicle sales. Vehicles are available for viewing and test drive at our showroom and sales are ordinarily concluded on-premises.
      6.2. No "change of mind" returns for on-premises vehicle purchases: If you buy a Vehicle on-premises, you do not automatically have a right to cancel just because you change your mind (your rights relate to faults/misdescription and other legal protections).
      6.3. Exceptional delivery/remote arrangements: In exceptional circumstances we may agree delivery or remote completion. If—and only if—we confirm in writing that a Vehicle sale is concluded without you attending our premises, it may be treated as a distance/off-premises contract with different information/cancellation requirements.
      6.4. For clarity: paying a Reservation Fee (see clause 7) is designed to secure a Vehicle for viewing and is not intended to conclude a Vehicle sale contract by itself.

     

    1. Reservation Fees (Not Deposits)
      7.1. You may be offered the option to pay a Reservation Fee to hold a Vehicle for a short period while you arrange a viewing/test drive. A reservation fee differs from a deposit because it secures the Vehicle for viewing and does not form a legal contract of sale.
      7.2. Reservation period: The reservation holds the Vehicle until the earliest of: (a) 3 days after payment; or (b) your agreed viewing appointment time; or (c) you tell us you no longer wish to proceed.
      7.3. Refunds (fair and transparent):
      (a) If you attend the viewing within the reservation period and decide not to buy, the Reservation Fee is refunded within 5 working days minus any expressly agreed, reasonable direct costs we have incurred solely due to your reservation (e.g., a paid independent inspection you requested in writing).
      (b) If you do not attend the agreed viewing appointment and do not reschedule within the reservation period, we may retain a reasonable portion of the Reservation Fee to reflect the loss of opportunity in holding the Vehicle off market, provided it is not excessive. (Unfair or excessive forfeitures are unenforceable.)
      (c) If we cancel the viewing or withdraw the Vehicle from sale for our own reasons, we will refund the Reservation Fee in full.
      7.4. If you buy the Vehicle: Unless we state otherwise in writing, the Reservation Fee will be applied towards the purchase price.
      7.5. Anti-fraud/chargebacks: We may refuse or refund a Reservation Fee and cancel the reservation where we reasonably suspect fraud, misuse of payment methods, or unauthorised transactions.
      Note: The Motor Ombudsman distinguishes a reservation fee from a deposit, and notes that paying a deposit online/over the phone alongside signed terms without visiting the retailer can amount to a distance sale with cancellation rights. These Terms are written so your Reservation Fee process does not (by itself) conclude a Vehicle sale contract.

     

    1. Formation of the Vehicle Sale Contract
      8.1. A Vehicle sale contract is formed only when all of the following have occurred:
      (a) you attend our premises (unless we expressly agree otherwise in writing under clause 6.3);
      (b) you have had a reasonable opportunity to inspect/test drive the Vehicle; and
      (c) we accept your purchase and issue a sales invoice/receipt and/or both parties sign an order form.
      8.2. We may refuse to sell a Vehicle or cancel a proposed sale prior to contract formation, including where the Vehicle is no longer available or where we suspect fraud.

     

    1. Price, Payment, and Collection/Delivery
      9.1. Prices are in GBP and are as stated on the listing/invoice at time of sale (subject to obvious error).
      9.2. Accepted payment methods: Bank Transfer, Cash.
      9.3. Title to the Vehicle passes on receipt of cleared funds (unless otherwise required by law).
      9.4. Collection is by appointment. Any delivery is by written agreement only.

     

    1. Part Exchange / "Sell Your Car"
      10.1. Where we agree to purchase your vehicle or accept part exchange, you confirm you are the legal owner (or authorised by the owner) and that the vehicle is free of undisclosed finance/encumbrances except as disclosed in writing.
      10.2. Any valuation is conditional upon inspection and verification of history/condition.

     

    1. Statutory Consumer Rights (Consumer Rights Act 2015)
      11.1. Nothing in these Terms limits or excludes your legal rights as a Consumer. Unfair terms are not enforceable.
      11.2. If you are a Consumer and a Vehicle is faulty, damaged, not as described, or not of satisfactory quality/fit for purpose, you may have remedies including repair, replacement, price reduction, or rejection depending on the circumstances and timing.
      11.3. Process to prevent misuse (while respecting your rights): If you believe there is a fault/misdescription:
      (a) notify us as soon as reasonably possible, describing the issue and when it occurs;
      (b) stop using the Vehicle if continued use could worsen damage;
      (c) make the Vehicle available for inspection/diagnosis within a reasonable time; and
      (d) provide relevant evidence you reasonably have (photos/videos/warning lights/diagnostic report).
      11.4. What is not covered as a "fault" for rejection/refund: normal wear and tear, consumables (e.g., bulbs, tyres, brake pads), damage caused after delivery, misuse/neglect, unauthorised modifications, accidents, or failure to follow maintenance requirements—unless we have misdescribed the Vehicle or breached legal obligations. (We may charge reasonable inspection/collection costs where an issue is confirmed to be caused by post-sale misuse or external damage.)
      11.5. Your rights are different if you have simply changed your mind and there is nothing wrong with the Vehicle.

     

    1. Workshop & Repair Services (including Window Tinting)
      12.1. Quotes/estimates: Any estimate is not a fixed price unless stated as such in writing. If additional work is required, we will seek your authorisation before proceeding (where reasonably practicable).
      12.2. Customer authority: You confirm you are authorised to present the vehicle for work and to authorise repairs/services.
      12.3. Road testing: You authorise us (and our staff/contractors) to move and road-test the vehicle as reasonably necessary for diagnosis/quality control.
      12.4. Parts: We may use OEM, OEM-equivalent, or other parts as agreed. Any parts removed may be disposed of unless you ask in advance to retain them (where lawful and safe).
      12.5. Payment & retention: We may retain possession of the vehicle until all sums due are paid (a lien), where lawful.
      12.6. Storage: If you do not collect your vehicle within 2 days after we notify you it is ready, we may charge reasonable storage at £15/day (or a reasonable market rate) and may take further steps if the vehicle is uncollected after a prolonged period, in accordance with law.
      12.7. Window tinting specific: We offer professional window tinting services. You are responsible for ensuring any tint specification you request complies with applicable road traffic laws; we can provide general guidance but do not provide legal certification unless expressly agreed in writing.

     

    1. Cancellations (Services Bookings)
      13.1. If you book a workshop/tinting appointment and cancel with less than 2 hours' notice or do not attend, we may charge a reasonable missed-appointment fee reflecting time reserved, provided it is fair and transparent. Unfair/excessive charges are unenforceable.

     

    1. Limitation of Liability
      14.1. We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
      14.2. Subject to clause 14.1, we are not liable for losses not reasonably foreseeable, and we are not liable for indirect or consequential losses.
      14.3. Where we are liable, our liability is limited to the price paid for the relevant goods/services, except where unlawful.

     

    1. Complaints and Disputes

      15.2. If we cannot resolve a dispute, you may have the right to use alternative dispute resolution (ADR) or to pursue a claim through the courts. This clause does not restrict your legal rights.

     

    1. Data Protection
      16.1. We process personal data in accordance with our Privacy Policy (see below).

     

    1. Governing Law
      17.1. These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction (subject to any mandatory consumer protections).

      Brought a 2014 Corsa from John in November 2025. John explained everything, gave me time to look around car, test drive for as long as I wanted. Car came with 3 month warranty. I had a problem a few weeks after purchase, where I unfortunately broke down, but this could have happened to anyone and would not have been something John would have known about. I contacted John he was super helpful and came to my home and fixed it on the weekend. He also topped up my petrol when taking car to workshop to fix. Amazing friendly service and best used car dealer I've dealt with. Would not hesitate to get a new car from John in future.
